Guest Waiver & Agreement

1. ENTRY REQUIREMENTS

Mimloo is an indoor playground and café designed exclusively for families with children. All adults must be accompanied by a child to enter the premises. Adults without children are not permitted inside and may use our to-go window located outside.

2. PARENTAL & GUARDIAN RESPONSIBILITY

The adult signing this waiver ("Guardian") accepts full and sole responsibility for the supervision, safety, and behavior of any minor(s) in their care at all times while on Mimloo's premises. Mimloo staff are not responsible for supervising, monitoring, or intervening in the care of any child.

3. WE ARE NOT A DAYCARE

Mimloo is a family play café — not a licensed daycare, childcare facility, or supervised child activity center. Our staff are not trained childcare workers and will not assume responsibility for any child's care, feeding, discipline, or wellbeing at any time.

4. NO DROP-OFF & STRICT NO RE-ENTRY POLICY

Drop-offs are strictly prohibited. At least one Guardian must remain inside Mimloo at all times while their child(ren) are present.

Guardians may not leave and return. If a Guardian exits the premises for any reason, they must take their child(ren) with them and fully check out. Re-entry requires completing a new check-in and accepting this waiver again.

Violations of this policy may result in immediate removal from the premises.

5. ASSUMPTION OF RISK

Guardian acknowledges that participation in play activities involves inherent physical risks, including but not limited to falls, collisions, bumps, cuts, and other injuries typical of an active indoor play environment. Guardian voluntarily assumes all such risks on behalf of themselves and their minor child(ren) and enters the premises with full awareness of these risks.

6. LIMITATION OF LIABILITY

To the fullest extent permitted by New York law, Mimloo, its owners, officers, employees, and agents shall not be liable for any injury, illness, loss, or property damage suffered by Guardian or their child(ren) on the premises arising from ordinary negligence, the actions of other guests, use of play equipment, or any other circumstance. This waiver does not apply to claims arising from gross negligence or intentional misconduct.

7. OTHER GUESTS' CHILDREN

The guardian is not responsible for, and must not physically intervene with, other guests' children. Any concerns about another child's behavior must be directed to a Mimloo staff member. Physical intervention involving another guest's child is strictly prohibited and may result in removal from the premises.

8. BEHAVIOR & COMPLIANCE

Guardian agrees to follow all Mimloo rules and staff instructions at all times. Mimloo reserves the right to ask any guest to leave for failure to comply with these terms, unsafe behavior, or conduct deemed disruptive — without refund or waiver of any minimum spend obligation.

9. FOOD ALLERGIES & DIETARY DISCLAIMER

Mimloo prepares food and beverages on-site. Our kitchen handles common allergens including but not limited to nuts, dairy, eggs, gluten, and soy. We cannot guarantee a completely allergen-free environment. Guardian is solely responsible for assessing whether Mimloo's food and beverages are safe for themselves and their child(ren). Please inform staff of any allergies before ordering. Mimloo is not liable for any allergic reactions or dietary-related incidents.

10. MINIMUM SPEND REQUIREMENT

Each visit carries a minimum food & beverage spend, which Guardian agrees to meet through purchases during the visit. Alternatively, the Guardian may simply purchase the minimum spend at the door to gain entry.

The minimum spend at the time of accepting this agreement is $35. It may change at any time.

If the minimum is not reached through orders placed during your visit, the difference is payable at the counter before you leave. By entering, you agree to this policy.

11. PRIVACY NOTICE

Mimloo collects your name, phone number, and — if you choose to provide it — your email address, for the sole purposes of administering this waiver and maintaining a record of your visit. Your information will not be sold to third parties. We will only send you marketing messages if you separately opt in, and you may stop them at any time. 12. GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of New York. Any disputes arising under this Agreement shall be subject to the exclusive jurisdiction of the courts of Queens County, New York.
